Terms & Conditions

1. Scope of Services

Max Smith Photo provides creative services including photography, videography, and digital content creation (“Services”). These Terms & Conditions govern the provision of Services and use of any deliverables produced by Max Smith Photo.

2. Booking, Deposits & Payments

  • A deposit may be required to secure your booking.

  • Payment schedule: 50% deposit upfront, with the remainder due upon delivery of final work.

  • Bookings are only confirmed once the deposit is received.

3. Cancellations & Reschedules

  • Cancellations or reschedules must be made at least 48 hours in advance.

  • Deposits are non-refundable but may be applied to a rescheduled date.

  • Late cancellations (less than 48 hours) may incur additional fees at the discretion of Max Smith Photo.

4. Refunds

  • Deposits are non-refundable.

  • Refunds may only be issued in exceptional circumstances at the discretion of Max Smith Photo.

5. Revisions & Deliverables

  • Clients are entitled to two rounds of revisions per project unless otherwise agreed.

  • Additional revisions or changes outside the original scope may incur extra fees.

  • Final deliverables will be delivered within the agreed timeline.

6. Intellectual Property / Usage

  • Max Smith Photo retains copyright of all content produced.

  • Clients are granted a license to use deliverables for personal or agreed commercial purposes only.

  • Unauthorized commercial use of content is prohibited.

7. Limitation of Liability

  • Max Smith Photo is not liable for any indirect, incidental, or consequential losses arising from the provision of Services.

  • In any circumstance, Max Smith Photo’s total liability will not exceed the total amount paid by the client for the Services.

8. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes arising will be subject to the jurisdiction of Victoria.
